These Terms & Conditions (“Terms”) govern your use of the A&D Equipment Rentals LLC website, adequipmentrentals.us, and your rental or use of equipment from A&D Equipment Rentals LLC (“A&D Equipment Rentals,” “we,” “us,” or “our”).
By accessing our website, submitting a rental request, making a reservation, signing a rental agreement, making a payment, or taking possession of equipment, you agree to these Terms and any applicable rental agreement provided to you.
Consent to Receive SMS Messages
By submitting your contact to A&D Equipment Rentals LLC, you agree to receive SMS messages related to reservation confirmations, pickup and delivery details, return reminders, overdue rental alerts and Other account or service-related notifications tied to your rental. - Opt-Out Policy
You can cancel SMS messages at any time. Reply STOP to any message to unsubscribe. After you send “STOP,” we will confirm your opt-out status with one final message, and you will no longer receive SMS messages from us unless you opt in again. - Message Frequency and Rates
Message frequency will vary depending on your service requests and account activity. Message and data rates may apply according to your mobile carrier’s plan. Carriers are not liable for delayed or undelivered messages. - Support and Contact

Rental Eligibility
Renters must provide accurate and complete information and must satisfy A&D Equipment Rentals’ applicable rental requirements.
We may require government-issued identification, a valid driver’s license, contact information, payment information, a security deposit or authorization, and additional information reasonably necessary to approve a rental.
We reserve the right to decline or cancel a rental when we reasonably believe that the renter does not satisfy our requirements or that the rental presents an unacceptable risk.
Reservations
A rental request or reservation submitted through our website does not necessarily constitute acceptance until A&D Equipment Rentals confirms the rental.
Equipment availability may change. We may contact you to confirm rental details, payment information, pickup/delivery arrangements, identification, or other requirements.
Rental Period
The rental period begins and ends according to the rental agreement or reservation confirmation provided to the renter.
The renter is responsible for returning equipment on time and in the condition required by the rental agreement.
Late Returns
Equipment must be returned by the agreed-upon return time. If equipment is returned late, additional charges may apply.
Unless otherwise stated in the applicable rental agreement, late equipment may be charged at two times the applicable daily rental rate for each additional day or portion of a day for which the equipment remains overdue, as permitted by applicable law.
A&D Equipment Rentals may also charge other documented costs resulting from a late return, including reasonable transportation, recovery, administrative, or other costs where permitted by law.
Continuing to possess equipment after the rental period expires does not create a new rental period or authorize continued use of the equipment.
Payment Authorization
You authorize A&D Equipment Rentals and its payment processors to charge amounts properly due under the applicable rental agreement, including rental charges, deposits or authorized holds, late-return charges, damage charges, missing-equipment charges, cleaning charges, repair costs, replacement costs, transportation or recovery costs, and other amounts expressly authorized by the rental agreement.
Payments may be processed through third-party payment providers such as Stripe.
Security Deposits and Payment Holds
A security deposit or payment authorization may be required before equipment is released.
The amount and conditions of any deposit or authorization will be communicated during the rental process or in the applicable rental agreement.
Authorized holds may remain subject to the processing timelines of the payment provider and financial institution.
Equipment Condition
The renter is responsible for inspecting equipment before use and promptly reporting any apparent damage, malfunction, or safety concern.
Equipment must be returned in substantially the same condition in which it was provided, except for ordinary wear and tear.
Proper Use of Equipment
The renter agrees to:
- Use equipment only for its intended purpose
- Follow manufacturer instructions
- Follow all applicable safety requirements
- Operate equipment only if legally qualified and permitted to do so
- Use appropriate protective equipment
- Not modify or alter equipment without written authorization
- Not remove identification markings
- Not allow unauthorized persons to operate equipment
- Not use equipment in an unsafe, illegal, reckless, or abusive manner
The renter is responsible for damage resulting from misuse, abuse, negligence, unauthorized use, improper operation, or failure to follow applicable instructions.
Damage, Loss, Theft, and Misuse
The renter may be financially responsible, to the extent permitted by law and the applicable rental agreement, for loss of or damage to equipment occurring during the rental period.
This may include damage caused by negligence, misuse, abuse, improper operation, unauthorized operation, failure to follow instructions, accidents, theft, loss, unauthorized transportation or relocation, or use outside the agreed rental purpose.
If equipment is lost or stolen, the renter must promptly notify A&D Equipment Rentals and, where appropriate, law enforcement.
Prohibited Uses
Unless expressly authorized in writing, equipment may not be used for illegal activities; subleased or rented to another person; sold, transferred, pledged, or loaned; used by an unauthorized operator; modified or dismantled; used outside its intended purpose; taken outside an agreed geographic area; or used in a manner that violates manufacturer requirements or applicable law.
Pickup and Delivery
If delivery is offered, delivery fees, mileage charges, pickup charges, and other applicable transportation charges will be disclosed during the rental process.
The renter is responsible for providing safe and reasonable access to the delivery or pickup location.
A&D Equipment Rentals may refuse delivery or pickup when conditions are unsafe or access is not reasonably available.
Cancellations and Refunds
Cancellation and refund terms may depend on the equipment, rental period, timing of cancellation, and applicable rental agreement.
Any applicable cancellation fees or refund limitations will be disclosed to the renter before or during the rental transaction when reasonably practicable.
Refunds, when approved, may be returned through the original payment method and may be subject to payment processor processing times.
Equipment Availability
We attempt to keep website inventory and availability information accurate.
However, equipment may become unavailable because of prior rentals, maintenance, damage, mechanical problems, delayed returns, emergencies, or other circumstances outside our reasonable control.
If equipment becomes unavailable, we may offer a replacement, reschedule the rental, or provide another appropriate remedy.
Website Information
We make reasonable efforts to provide accurate equipment descriptions, photographs, specifications, prices, and availability.
However, photographs and descriptions may not show every feature or minor difference in equipment.
We reserve the right to correct errors, update information, and change pricing or availability before a rental is confirmed.
Website Use
You agree not to interfere with the operation of our website, attempt unauthorized access, submit fraudulent information, use the website for unlawful purposes, introduce malicious code or software, scrape or misuse website content, impersonate another person, or attempt to circumvent security measures.
Electronic Communications
When you provide an email address or telephone number, you agree that A&D Equipment Rentals may contact you regarding your rental, account, reservation, payment, equipment, customer service requests, or other transactions.
Where required, promotional communications will be sent only after the appropriate consent has been obtained.

Limitation of Liability
To the maximum extent permitted by applicable law, A&D Equipment Rentals LLC will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from your use of rented equipment or our website.
Nothing in these Terms is intended to waive or limit liability that cannot legally be waived or limited under applicable law.
Indemnification
To the maximum extent permitted by law, the renter agrees to defend, indemnify, and hold harmless A&D Equipment Rentals LLC and its owners, employees, agents, and representatives from claims, damages, losses, liabilities, costs, and expenses arising from the renter’s breach of these Terms, violation of applicable law, misuse of equipment, negligence or misconduct, unauthorized use of equipment, damage to equipment, or claims resulting from the renter’s use or possession of equipment.
This provision does not apply to the extent a claim results from conduct for which indemnification cannot legally be required.
Insurance
Where insurance is required for a particular rental, the renter must provide proof of required coverage before taking possession of the equipment.
Any insurance requirements will be stated in the applicable rental agreement.
Governing Law
These Terms will be governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute will be handled in a court or other forum with proper jurisdiction as required or permitted by applicable law.
Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Changes to These Terms
A&D Equipment Rentals LLC may update these Terms from time to time.
The updated Terms will become effective when posted on the website unless otherwise stated.
The Terms applicable to a particular rental may also include additional provisions contained in the rental agreement signed or accepted by the renter.
Entire Agreement
These Terms, together with any applicable rental agreement, reservation confirmation, policies, disclosures, and other written terms provided to the renter, constitute the agreement governing the applicable transaction.
If there is a conflict between these website Terms and a separately signed rental agreement, the separately signed rental agreement will control to the extent permitted by law.
